A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF DOUGLAS COUNTY, KANSAS
AMENDING DOUGLAS COUNTY CODE SECTIONS 9-107
THRU 9-112

WHEREAS, Chapter 9 of the Douglas County Code deals
with Public Works; and

WHEREAS, Sections 9-107 thru 9-112 of Chapter 9 of the
Douglas County Code deal with the placement of public
utilities in the right-of-way; and

WHEREAS , it has been determined by the Board that
there is a need to amend Sections 9-107 thru 9-112 of
the Douglas County Code;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KAN-
SAS AS FOLLOWS:

SECTION 1. Adoption of Regulations on Construction
Work in the Right-of-Way
. The following is adopted as
part of Chapter 9 (Public Works), Article 1 (General Pro-
visions) of the Douglas County Code:

CHAPTER 9. PUBLIC WORKS
ARTICLE 1. GENERAL PROVISIONS

9-107 CONSTRUCTION WORK WITHIN THE PUBLIC
RIGHT-OF-WAY.

9-107-1 DEFINITIONS.

a. "Construction work" as used in this article means
any of the following activities:

(1) Excavation, fill, grading, paving or other modifica-
tion of the ground surface;
(2) Construction of any post, pole, sign, wall, fence,
gate, structure, enclosure or other fixed object;
(3) Construction of any footing, foundation, vault, man-
hole or other buried structure;
(4) Installation of any pipe, pipeline, conduit, cable,
wire, antenna, equipment or related fixtures; or
(5) Planting of trees or other vegetation that would
create a physical or visual barrier; or
(6) Removal of trees or tree limbs or other vegetation
by physical or chemical means to accommodate public
utilities.

b. "Person" means any individual, association, firm,
partnership, corporation, public utility or private entity.

c. "Public right-of-way" means the area of real property
in which the County has a dedicated or acquired
right-of-way interest for the purpose of constructing
and maintaining travel lanes, roadside ditches, cul-
verts, bridges, signage and other features of a public
road.

d. "Public utility" means those utilities identified in
K.S.A. 66-104, and amendments thereto.

e. "Public utility facility" or "facility" means a pipe,
pipeline, conduit, cable, wire, vault, ...

CITY OF LAWRENCE, KAN-
SAS, REPEALING CHAPTER
XVII, ARTICLE 3, SECTION
17-312, CODE OF THE CITY
OF LAWRENCE, KANSAS,
2015 EDITION, AND AMEND-
MENTS THERETO, AND EN-
ACTING IN ITS PLACE
CHAPTER XVII, ARTICLE 3,
17-312, PERTAINING TO
PARKING METERS.

BE IT ORDAINED BY THE
GOVERNING BODY OF THE
CITY OF LAWRENCE, KAN-
SAS: SECTION 1: Chapter
XVII, Article 3, Section
17-312 of the Code of the
City of Lawrence, Kansas,
2015 Edition, and amend-
ments thereto, is hereby
repealed. SECTION 2:
Chapter XVII, Article 3,
Section 17-312 of the Code
of the City of Lawrence,
Kansas, 2015 Edition, and
amendments thereto, is
hereby enacted to read as
follows: 17-312 PARKING IN
THE 1100 BLOCKS OF MIS-
SISSIPPI STREET AND INDI-
ANA STREET. (A) It shall be
unlawful and a violation of
this Article for any person
to cause, allow, permit, or
suffer any vehicle regis-
tered in the name of or op-
erated by such person to
park overtime, exceeding
the posted two-hour limit,
in the 1100 blocks of Mis-
sissippi Street and Indiana
Street without concur-
rently depositing in the ap-
propriate parking meter
the parking fee of $1.50 per
hour. Violators of this sub-
section shall be prose-
cuted and adjudicated pur-
suant to Section 17-304 of
this Article, except that:(1)
The penalty for any viola-
tion of Sections 17-305 and
17-306 in the 1100 Blocks of
Mississippi Street and In-
diana Street shall be an as-
sessment in the amount of
$15.00, except that:(a) The
penalty for any violation of
Sections 17-305 or 17-306
committed by a habitual
violator, as that term is de-
fined at Section 17-417,
and amendments thereto,
shall be $75.00, plus any
applicable court costs.(b)
If a person fails to pay the
$15.00 assessment within
fourteen (14) days of the
assessment becoming
due, the violation shall be
punished by an additional
fine of $25.00, exclusive of
court costs.(B) The provi-
sions of Section 17-304
shall apply to this Section
to the extent that they are
not inconsistent with the
preceding Subsection.
SECTION 3. If any section,
sentence, clause, or
phrase of this ordinance is
found to be unconstitu-
tional or is otherwise held
invalid by any court of
competent jurisdiction, it
shall not affect the validity
of any remaining part of
this ordinance. SECTION 4.
This ordinance shall be in
full force and effect from
and after its passage and
publication as provided by
law.PASSED by the Govern-
ing Body of the City of
Lawrence, Kansas, this
20th day of September
