PLAN, DESIGNATING A
NEIGHBORHOOD REVITALIZATION AREA, AND ESTABLISHING A FUND FOR 705
MASSACHUSETTS STREET,

ACCORDANCE WITH THE
KANSAS NEIGHBORHOOD
REVITALIZATION ACT OF
1994, CODIFIED AS
AMENDED AT K.S.A
12-17,114 ET SEQ.

WHEREAS, pursuant to authority granted it by the
Kansas Neighborhood Revitalization Act of 1994,
codified as amended at
K.S.A. 12-17,114 et seq.
("the Act"), the Governing
Body of the City of Lawrence, Kansas, desires to
adopt a plan for the revitalization of 705 Massachusetts Street, Lawrence,
Douglas County, Kansas,
to designate 705 Massachusetts Street as a
Neighborhood Revitalization Area, and to create a
fund to finance the redevelopment of the area and
to provide rebates authorized by the Act, all in accordance with the
Act;WHEREAS, at its January 20, 2015 public meeting, in accordance with the
Act, the Governing Body
scheduled a public hearing
for February 10, 2015, for
the purpose of considering
the Neighborhood Revitalization Plan and Program
for 705 Massachusetts
Street; WHEREAS, in accordance with the Act, the
Governing Body caused
notice of such public hearing to be published in The
Lawrence Journal-World, a
newspaper of general circulation within the City, on
January 26, 2015 and February 2, 2015; and
WHEREAS, at its February
10, 2015 public meeting,
pursuant to said public notice, the Governing Body
considered the Neighborhood Revitalization Plan
and Program for 705 Massachusetts Street. BE IT
ORDAINED BY THE GOVERNING BODY OF THE CITY
OF LAWRENCE, KANSAS:
SECTION 1. The
above-stated recitals are
incorporated herein by reference and shall be as effective as if repeated verbatim. SECTION 2. The Governing Body hereby adopts
the Neighborhood Revitalization Plan and Program
for 705 Massachusetts
Street ("Revitalization
Plan"), attached hereto as
Exhibit A, and incorporates
the same herein by reference. SECTION 3. The Governing Body has determined that the real property, legally described as:
Lot 25 and the North Half
of Lot 27 on Massachusetts
Street, in the City of Lawrence, Douglas County,
Kansas, and commonly
known as 705 Massachusetts Street, Lawrence,
Douglas County, Kansas,
constitutes an area which
by reason of the presence
of a substantial number of
deteriorated or deteriorating structures, defective or
inadequate streets, incompatible land use relationships, faulty lot layout in
relation to size, adequacy,
accessibility or usefulness,
unsanitary or unsafe conditions, deterioration of
site or other improvements, diversity of ownership, tax or special assessment delinquency exceeding the actual value of the
land, defective or unusual
conditions of title, or the
existence of conditions
which endanger life or
property by fire and other
causes, or a combination
of such factors, substantially impairs or arrests
the sound growth of a municipality, retards the provision of housing accommodations or constitutes
an economic or social liability and is detrimental to
the public health, safety or
welfare in its present condition and use. Accordingly, pursuant to the Act,
the Governing Body designates that real property,
legally described above, as
the 705 Massachusetts
Street Neighborhood Revitalization Area ("the Revitalization Area"). SECTION
4. The Governing Body
hereby creates a Neighborhood Revitalization
Fund pursuant to K.S.A.
12-17,118 in order to finance the redevelopment
of the Revitalization Area
and to provide a rebate of
property tax increments as
scheduled in the Revitalization Plan. SECTION 5.
This ordinance shall take
effect and be in force from
and after its passage and
publication as provided by
law. ADOPTED by the Governing Body of the City of
Lawrence, Kansas, this

USE PERMIT FOR A DAY
CARE CENTER ON THAT
REAL PROPERTY COMMONLY KNOWN AS 1100
KASOLD DRIVE, LAWRENCE,
DOUGLAS COUNTY, KANSAS.

BE IT ORDAINED BY THE
GOVERNING BODY OF THE
CITY OF LAWRENCE, KANSAS: SECTION 1. In accordance with City of Lawrence, Kan., Code
20-1306 and 20-1307(c)(2)
(Jan. 1, 2015), as amended,
the Governing Body of the
City of Lawrence, Kansas,
hereby grants to the
owner/applicant Special
Use Permit, No.
SUP-14-00488, for that real
property commonly known
as 1100 Kasold Drive, Lawrence, Douglas County,
Kansas, and bearing the
following legal description, to-wit: LOT 12, BLOCK
4, ORCHARDS NO. 4 SUBDIVISION, IN THE CITY OF

cause for the City to revoke Special Use Permit,

RESOLUTION NO. 7109
Opposition to
SB 212/HB 2096

WHEREAS, The City of Lawrence, Kansas was
founded in 1854 in an effort to keep the Kansas
territory free from slavery.
The city has a rich history
in regards to protecting
the rights of its citizens,
and; WHEREAS, The City of
Lawrence, Kansas has an
elected Governing Body
consisting of five duly
elected Lawrence Citizens
who serve on the City
Commission, with one of
its members acting as the
mayor. The Governing
Body passes resolutions
and ordinances, establishes policies for the City,
approves the budget and
hires the City Manager,
and; WHEREAS, it is the
policy of the Governing
Body of the City of Lawrence, Kansas, not to come
under the provisions of
K.S.A. 75-4321 et. seq., generally known as the Kansas Public Employee Employer Relations law, and;
WHEREAS, the Governing
Body of the City of Lawrence fully subscribes to
the precept of Home Rule
as delineated in Article XII,
Section 5 of the Kansas
Constitution, in that employee relations are most
suitably conducted at the
local level, and; WHEREAS,
The City of Lawrence has
operated under city resolution 6817 for over 30
years. The resolution
grants certain rights to its
employee groups, Lawrence Police Officers' Association (LPOA) and the
International Association
of Firefighters Local 1596
(IAFF Local 1596) to negotiate in good faith, wages,
benefits and working conditions. These agreements
have been documented in
a Memorandum of Understandings, which bind the
city and the employee
groups to an agreement
for a specific time period.
NOW, THEREFORE, it is the
belief of this Governing
Body of the City of Lawrence, Kansas that if Kansas SB 212/HB 2096 were to
pass and be signed into
law by the Governor of
Kansas it would directly
interfere with the duty of
the Governing Body of the
City of Lawrence, Kansas,
which is to provide services to the citizens of
Lawrence, Kansas by and
through its employees,
and may compromise the
"powers and authority"
granted to it by Article XII,
Section 5, part d, of the
Kansas Constitution,
which "shall be liberally
construed for the purpose
of giving to cities the largest measure of
self-government," and, it is
the petition of the Governing Body of the City of
Lawrence, Kansas that the
elected Representatives of
the State of Kansas should
respect the City of
Lawrence's right to
self-govern and will vote
against SB 212/HB 2096
and/or any other similar
measures. ADOPTED by the
Governing Body of the City
of Lawrence, Kansas, this
