was seized at 3007 University Drive, Lawrence,
Douglas County, KS 66049,
in the living room on the
bottom shelf of the coffee
table, on or about the 29th
day of September, 2014, as
property subject to forfeiture.

The 13 grams of marijuana
was seized at 3007 University Drive, Lawrence,

in the living room on the

HOME RULE RESOLUTION
NO. HR-14-10-4

A HOME RULE RESOLUTION
PROHIBITING THE USE OF
ENGINE BRAKING ON PORTIONS OF N 1000 ROAD

WHEREAS , K.S.A. 19-101a,
and amendments thereto,
authorizes the Board of
County Commissioners
(hereinafter the "Board")
to transact all County business and perform all
powers of local legislation
and administration it
deems appropriate, including the enactment of legislation designed to protect
the health, safety, welfare,
and quality of life of the
citizens of Douglas
County; and

WHEREAS , the Board is the
local authority having jurisdiction over county and
township highways within
Douglas County; and

WHEREAS , the Board has
determined that the use of
engine braking on portions
of N 1000 Road, described
below, is causing unnecessary noise and disruption
to the lives of residents
near such Road and, therefore, desires to prohibit
the use of such breaking
mechanisms on such portions of N 1000 Road.

NOW, THEREFORE , BE IT
RESOLVED BY THE BOARD
OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY,
KANSAS, SITTING IN REGULAR SESSION AND INTENDING TO EXERCISE THE
POWERS OF HOME RULE
LEGISLATION PURSUANT
TO K.S.A. 19-101a, DOES
HEREBY RESOLVE AS FOLLOWS:

1. Prohibition . The use of
engine braking, including
compression release engine brakes, frequently referred to as Jake Brakes, is
prohibited on the following described county and
township highways:

Westbound traffic on N
1000 Road, from a point
100 yards west of Wells
Overlook Drive to E 1338
Road

2. Violations . Persons who
violate the provisions of
this Resolution shall be
guilty of disobeying an official traffic control device
and punished as provided
in K.S.A. 8-2118, as
amended.

3. Effective date . This
Resolution shall become
effective upon publication
one time in the official
County newspaper and after appropriate traffic control devices giving notice
thereof are erected upon
the above described
county and township highways.

PLAN, DESIGNATING A
NEIGHBORHOOD REVITALIZATION AREA, AND ESTABLISHING A FUND FOR 900
DELAWARE STREET, LAWRENCE, DOUGLAS COUNTY,
KANSAS, ALL IN ACCORDANCE WITH THE KANSAS
NEIGHBORHOOD REVITALIZATION ACT OF 1994, CODIFIED AS AMENDED AT K.S.A
12-17,114 ET SEQ.

WHEREAS, pursuant to authority granted it by the
Kansas Neighborhood Revitalization Act of 1994,
codified as amended at
K.S.A. 12-17,114 et seq.
("the Act"), the Governing
Body of the City of Lawrence, Kansas, desires to
adopt a plan for the revitalization of 900 Delaware
Street, Lawrence, Douglas
County, Kansas, to designate 900 Delaware Street
as a Neighborhood Revitalization Area, and to create
a fund to finance the redevelopment of the area and
to provide rebates authorized by the Act, all in accordance with the Act;
WHEREAS, at its August 26,
2014 public meeting, in accordance with the Act, the
Governing Body scheduled
a public hearing for September 23, 2014, for the
purpose of considering the
Neighborhood Revitalization Plan and Program for
900 Delaware Street;
WHEREAS, in accordance
with the Act, the Governing Body caused notice of
such public hearing to be
published in The Lawrence
Journal-World, a newspaper of general circulation
within the City, on September 8, 2014 and September
15, 2014; and WHEREAS, at
its September 23, 2014
public meeting, pursuant
to said public notice, the
Governing Body considered the Neighborhood Revitalization Plan and Program for 900 Delaware
Street. BE IT ORDAINED BY
THE GOVERNING BODY OF
THE CITY OF LAWRENCE,
KANSAS: SECTION 1. The
above-stated recitals are
incorporated herein by reference and shall be as effective as if repeated verbatim. SECTION 2. The Governing Body hereby adopts
the Neighborhood Revitalization Plan and Program
for 900 Delaware Street
("Revitalization Plan"), attached hereto as Exhibit A,
and incorporates the same
herein by reference. SECTION 3. The Governing
Body finds that the real
property, legally described
as: Lot 1, a final plat of the
9 Del Lofts Addition in the
City of Lawrence, Douglas
County, Kansas, and commonly known as 900 Delaware Street, Lawrence,
Douglas County, Kansas,
constitutes an area which
by reason of faulty lot layout in relation to size, adequacy, accessibility or
usefulness impedes the
provision of housing accommodations, and in its
current undeveloped condition, constitutes an economic or social liability
and is detrimental to the
public health, safety or
welfare, and such condition is one of the conditions described at K.S.A.
12-17, 115(c), and amendments thereto. The Governing Body further finds
that the rehabilitation or
redevelopment of the area
is necessary to protect the
public health, safety, or
welfare of the residents of
the City of Lawrence, Kansas. Accordingly, pursuant
to the Act, the Governing
Body hereby designates
that real property, legally
described above, as the
900 Delaware Street Neighborhood Revitalization
Area ("the Revitalization
Area"). SECTION 4. The
Governing Body hereby
creates a Neighborhood
Revitalization Fund pursuant to K.S.A. 12-17,118 in
order to finance the redevelopment of the Revitalization Area and to provide
a rebate of property tax increments as scheduled in
the Revitalization Plan.
SECTION 5. This ordinance
shall take effect and be in
force from and after its
passage and publication
as provided by law.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY
OF LAWRENCE, KANSAS: SECTION 1: From and after the
effectiveness of this ordinance the City Engineer is
hereby directed to amend the Schedule of Truck Delivery Routes (Schedule 28), maintained by the Office of
the City Engineer, as follows: SCHEDULE 28 TRUCK DELIVERY ROUTES Truck Delivery Routes are hereby established in the following locations. Intracity deliveries
shall be made via the most direct route between origin
and destination using truck routes whenever possible.
Trucks making multiple deliveries shall use truck
routes whenever possible to reach their initial destination; trucks may leave truck routes using truck delivery
routes following the most direct route between stops
and back to a truck route.

A Home Rule Resolution
of the Board of County
Commissioners of Douglas County, Kansas,
Amending Resolution
93-15 and Article 9 of
Chapter 1 of the Douglas
County Code, Dealing
with Smoke-Free Work
Place.

WHEREAS
, K.S.A. 19-101a,
et seq authorizes the
Board of County Commissioners of each county to
transact all county business and perform all
powers of local legislation
and administration it
deems appropriate, including the levy of certain
taxes, excise fees, and
other charges; and
WHEREAS , the governing
body of the County of
Douglas, Kansas adopted
Resolution No. 93-15 prohibiting smoking within all
county-owned or leased
buildings and vehicles;
and
WHEREAS , Resolution No.
93-15 determined that
smoking is hazardous to
the health of all persons
who may come in contact
with the smoke generated
thereby; and
WHEREAS , Resolution No.
93-15 is codified in Article
9 of Chapter 1 of the Douglas County Code; and
WHEREAS , the Board of
County Commissioners
has determined it is in the
best interests of the
health, safety and welfare
of the public that smoking
within county-owned and
leased buildings and vehicles be prohibited, and
that prohibition includes
e-cigarettes and vaporizers.
NOW THEREFORE BE IT RESOLVED , by the governing
body of Douglas County,
Kansas:

Section 1. Article 9 of
Chapter 1 of the Douglas
County Code is amended
and restated to read as
follows:

ARTICLE 9. SMOKING IN
PUBLIC BUILDINGS AND
VEHICLES

1-901 It shall be unlawful for any
person to smoke within a
building or vehicle which
is owned or leased by
Douglas County, Kansas.

1-902 There shall be no areas
within buildings or vehicles which are owned or
leased by Douglas County,
Kansas, designated as
smoking areas. The
County Administrator may
designate areas outside of
buildings owned or leased
by the County as areas in
which smoking is permitted.

1-903 Smoking shall be defined
as the use of cigarettes,
cigars, pipes, and shall include nicotine delivery devices that create a smoke
or vapor, such as
e-cigarettes and vaporizers.

1-904 Violation of this Article
shall be deemed to be in
violation of the provisions
of the Kansas Indoor Clean
Air Act, K.S.A. 21-6109
through 21- 6116, inclusive,
as amended. To the extent
that the prohibitions in
this Article are broader
than the foregoing act, violations may be prosecuted
the same as violations of
county codes and regulations, and the penalty shall
be the same as for violations of K.S.A. 21-6110, as
amended.

Section 2. This Resolution
shall take effect and be in
full force from and after its
adoption and publication
one time in the official
County newspaper.

BE IT ORDAINED BY THE
GOVERNING BODY OF THE
CITY OF LAWRENCE, KANSAS: SECTION 1. In accordance with City of Lawrence, Kan., Code
20-1306 and 20-1307(c)(2)
(July 1, 2013), as amended,
the Governing Body of the
City of Lawrence, Kansas,
hereby grants to the
owner/applicant Special
Use Permit, No.

(a) The applicant shall provide to the Planning Office
a photometric plan for review and approval prior to
the release of the SUP site
plan for building permits.
(b) The Applicant shall
provide a revised site plan
with the following
changes: (i) The location
and height of all exterior
lighting shall be shown on
the revised site plan. (ii) The landscaping sheet
shall be revised and shall
be approved by the City's
Horticulture Manager. (iii)
The dimensions of the solar array pad shall be
noted on Sheet 3. (iv) The
revised site plan shall provide a 75-foot, Type 3 Bufferyard along the perimeter
of the site, except for
those areas within the protected riparian area and
within the 41st Street corridor interior to the site.
(v) The following note
shall be added to the revised site plan: "The Bufferyard Landscaping and
Perimeter Parking Lot
Landscaping requirement
along 41st Street interior
to the site has been
waived due to the fact that
the subject property is located on both sides of the
street." SECTION 4. Failure
of the applicant, owner, or

RESOLUTION NO. 7094

A RESOLUTION SETTING
OUT THE FINDINGS AND DETERMINATIONS OF THE
GOVERNING BODY OF THE
CITY OF LAWRENCE, KANSAS, AND ORDERING THE
CONSTRUCTION OF A DEDICATED LEFT TURN LANE
ALONG BOB BILLINGS
PARKWAY BETWEEN
GEORGE WILLIAMS WAY
AND BOBWHITE DRIVE, INCLUDING PAVEMENT, CURB
AND GUTTER, SIDEWALKS,
BIKE LANES, STORM
SEWER, STRIPING, AND
OTHER NECESSARY AND
APPROPRIATE IMPROVEMENTS.

WHEREAS, on October 1,
2014, certain property
owners filed a petition
pursuant to K.S.A. 12-6a01
et seq. (the "Act"), requesting that the governing
body of the City of Lawrence, Kansas (the "City")
make certain improvements within the City without notice and hearing,
and assess the costs of
such improvements
against the property described in said petition;
and WHEREAS, the Governing Body hereby finds that
the petition has been
signed by all the owners of
property to be included in
the proposed improvement district and is therefore sufficient pursuant to
the Act; and WHEREAS, the
Governing Body hereby
finds that all of the property benefited by the proposed improvement is included in the proposed improvement district; and
WHEREAS, the Governing
Body hereby finds that the
following improvements
and the creation of the following improvement district is necessary and advisable. BE IT RESOLVED BY
THE GOVERNING BODY OF
THE CITY OF LAWRENCE,
KANSAS: Section 1. The
Governing Body of the City
hereby finds and determines that it is advisable
to construct the following
improvement, and hereby
authorizes and orders the
following improvements to
be made in accordance
with K.S.A. 12-6a01 et seq.:
The construction of a dedicated left turn lane along
Bob Billings Parkway between George Williams
Way and Bobwhite Drive,
including pavement, curb
and gutter, sidewalks, bike
lanes, storm sewer, striping, and other necessary
and appropriate improvements (the
"Improvements"). Section
2. The estimated or probable cost of the improvements is two hundred fifty
thousand dollars
($250,000) (to be increased
at the pro rata rate of 1
percent per month from
and after the adoption
date of this Resolution),
plus costs of issuance and
plus costs of interest on
any temporary financing.
Section 3. The improvement district shall consist
of those tracts of land legally described as follows:
Lot 1 Corpus Christi Addition, an addition to the
City of Lawrence, Douglas
County, Kansas (the
"Improvement District").
Section 4. The method of
assessment shall be:
Equally per lot for each lot
in the improvement district. Section 5. The apportionment of costs shall be:
one hundred percent
(100%) of the cost of the
Improvements shall be assessed to the Improvement District and no costs
of the Improvements shall
be paid by the
City-at-large. Section 6.
The City may adopt an ordinance establishing the
maximum amount of special assessments prior to
construction of the Improvements, all as provided by K.S.A. 12-6a09, as
amended. Section 7. The
City expects to make capital expenditures on and after the date of adoption of
this Resolution in connection with the Improvements, and intends to reimburse itself for such expenditures with the proceeds of one or more
series of general obligation bonds and temporary
notes of the City in the estimated maximum principal amount of $250,000 (to
be increased at the pro
rata rate of 1 percent per
month from and after the
date of adoption of this
Resolution) plus costs of
issuance and plus interest
on any temporary financing. Section 8. The City
Clerk shall record this Resolution in the real estate
records of Douglas County,
Kansas. Section 9. This
Resolution shall become
effective upon its publication once in the official
City newspaper. ADOPTED
by the Governing Body of
the City of Lawrence, Kansas, this 14th day of October, 2014.
