ORDINANCE NO. 8971

AN ORDINANCE ADOPTING
THE REDEVELOPMENT
PROJECT PLAN FOR THE
NORTH PROJECT AREA OF
THE NINTH & NEW HAMPSHIRE REEVELOPMENT DISTRICT AND APPROVING A
REDEVELOPMENT AGREEMENT RELATED THERETO.

WHEREAS, pursuant to the
provisions of K.S.A. 12-1770
et seq., as amended (the
"Act"), the City of Lawrence, Kansas (the "City")
is authorized to establish
redevelopment districts
within a defined area of
the City which is found by
the City to be an
"enterprise zone" as defined in the Act, and is
therefore an "eligible
area" as said term is defined in the Act; and
WHEREAS, the Governing
Body adopted Resolution
No. 6967 on June 19, 2012
calling for a public hearing
considering the establishment of a redevelopment
district to be held by the
Governing Body on July 24,
2012; and WHEREAS, the
Governing Body adopted
Resolution No. 6968 making a finding that the area
of the proposed Redevelopment District as hereinafter described was properly designated as an enterprise zone prior to July
1, 1992 by resolution of the
City pursuant to K.S.A.
12-17,107 through 12-17,113
prior to its repeal; and
WHEREAS, notice of the
public hearing was given
as required by the Act, except that the Douglas
County Commission and
the Board of Education of
USD #497 have each
waived the required notice
to them under the Act; and
WHEREAS, the public hearing was held on July 24,
2012 and closed on the
same day; and WHEREAS,
the City by the adoption of
Ordinance No. 8768 on August 7, 2012, created a redevelopment district (the
"Redevelopment District")
consisting of two redevelopment project areas (the
"North Project Area" and
the "South Project Area"),
all pursuant to the Act;
and WHEREAS, the City is
considering the adoption
of a redevelopment project
plan entitled Ninth & New
Hampshire Redevelopment
District North Project Area
Redevelopment Project
Plan and dated January 27,
2014 (the "Project Plan")
which provides for the redevelopment of the North

WHEREAS, on February 24,

WHEREAS, the Governing Body of the City of Lawrence, Kansas (the "City"), by Resolution No. 7059 authorized the following improvements (the "Improvements") in accordance with K.S.A.12-6a01 et seq.: THE CONSTRUCTION OF ATCHISON AVENUE
FROM W. 31ST STREET TO W. 32ND STREET, THE CONSTRUCTION OF 32ND STREET

TRANSPORTATION DEVELOPMENT DISTRICT IN LAWRENCE, KANSAS; AUTHORIZING THE MAKING OF CERTAIN TRANSPORTATION PROJECT IMPROVEMENTS RELATING THERETO; APPROVING THE ESTIMATED COSTS
OF SUCH TRANSPORTATION PROJECT IMPROVEMENTS;
PROVIDING FOR THE METHOD OF FINANCING; AUTHORIZING THE IMPOSITION OF A TRANSPORTATION DISTRICT
SALES TAX WITHIN THE TRANSPORTATION DEVELOPMENT DISTRICT IN LAWRENCE, KANSAS; ESTABLISHING
A METHOD OF COLLECTION OF SUCH SALES TAX; AND
PROVIDING FOR THE SEGREGATION OF SUCH SALES TAX
REVENUES FOR THE PAYMENT OF THE COSTS OF CERTAIN TRANSPORTATION PROJECTS WITHIN SUCH TRANSPORTATION DEVELOPMENT DISTRICT (9TH & NEW
HAMPSHIRE)

WHEREAS, K.S.A. 12-17,140 et. seq. (the "Act") authorizes the governing body of any city or county to create
transportation development districts ("Transportation
Districts") within such jurisdiction, to acquire interests
in property and to construct any project or undertaking
therein to improve any bridge, street, road, highway access road, interchange, intersection, signing, signalization, parking lot, bus stop, station, garage, terminal,
hangar, shelter, rest area, dock, wharf, lake or river
port, airport, railroad, light rail or other mass transit facility and any similar or related project or infrastructure including, but not limited to, utility relocation; sanitary and storm sewers and lift stations; drainage conduits, channels and levees; streetlight fixtures, connection and facilities; underground gas, water, heating and
electrical services and connections located within or
without the public-right-of-way; sidewalks and pedestrian underpasses or overpasses; and water main and
extensions; and including a building facade but only
when part of remodeling, repairing, enlarging or reconstructing an existing building (collectively,
"Transportation Projects"); and WHEREAS, the Act further authorizes said governing body, in order to pay the
costs of such Transportation Projects, to levy a transportation district sales tax on the selling of tangible
personal property at retail or rendering or furnishing
services taxable pursuant to the Kansas retailer's sales
tax act within Transportation Districts in any increment
of .10% or .25% not to exceed 1.0% and/or the levy of
special assessments upon property within such Transportation Districts, and to issue revenue bonds payable
from such sales taxes and/or special assessments; and
WHEREAS, a petition (the "TDD Petition") was filed with
the City Clerk on October 11, 2013 of the City of Lawrence, Kansas (the "City"), proposing the creation of a
Transportation District, the making of Transportation
Projects therein and the imposition of a transportation
district sales tax in order to pay the costs of such

RESOLUTION NO. 14-09

A RESOLUTION RELATIVE
TO THE CREATION OF A
FIRE DISTRICT, WITH THE
BOUNDARIES CONSISTING
OF ALL OF PALMYRA
TOWNSHIP; AND ORDERING
A PUBLIC HEARING.
WHEREAS, the Board of
County Commissioners of
Douglas County, Kansas
(the "Board") has, on its
own motion and at the request of various persons,
determined that it is advisable and in the public interest to organize a fire
district pursuant to K.S.A.
19-3601 et seq., for the protection of lives and property from the hazards of
fire; and
WHEREAS, the boundaries
of the proposed fire district are all of Palmyra
Township.
NOW, THEREFORE, it is resolved by the Board pursuant to K.S.A. 19-3601, et
seq., as follows:

Section 1. A public hearing
concerning the advisability of the organization of
such a fire district shall be
held before the Board on
May 14, 2014 at 6:35
o'clock p.m., or as soon
thereafter as it may be
heard, at the County Commission Room, 2nd Floor,
1100 Massachusetts St.,
Lawrence, Kansas.
Section 2. At the public
hearing, the Board may
abandon its proposal, or
may adopt a final resolution organizing the fire district and declaring the
boundaries thereof as finally determined.
Section 3. This resolution
shall be published in the
official County newspaper
on April 18, 2014, April 25,
2014, and May 2, 2014, together with a map showing the territory of the proposed fire district and a
notice of public hearing on
the advisability of organizing such fire district.

WHEREAS, the Board of
County Commissioners of
Douglas County, Kansas
(the "Board") has, on its
own motion and at the request of various persons,
determined that it is advisable and in the public interest to organize a fire
district pursuant to K.S.A.
19-3601 et seq., for the protection of lives and property from the hazards of
fire; and
WHEREAS, the boundaries
of the proposed fire district are all of Willow
Springs Township.
NOW, THEREFORE, it is resolved by the Board pursuant to K.S.A. 19-3601, et
seq., as follows:
Section 1. A public hearing
concerning the advisability of the organization of
such a fire district shall be
held before the Board on
May 14, 2014 at 6:35
o'clock p.m., or as soon
thereafter as it may be
heard, at the County Commission Room, 2nd Floor,
1100 Massachusetts St.,
Lawrence, Kansas.
Section 2. At the public
hearing, the Board may
abandon its proposal, or
may adopt a final resolution organizing the fire district and declaring the
boundaries thereof as finally determined.
Section 3. This resolution
shall be published in the
official County newspaper
on April 18, 2014, April 25,
2014, and May 2, 2014, together with a map showing the territory of the proposed fire district and a
notice of public hearing on
the advisability of organizing such fire district.

A RESOLUTION OF THE
CITY OF LAWRENCE, KANSAS, DECLARING A CERTAIN STRUCTURE WITHIN
THE CITY OF LAWRENCE,
DOUGLAS COUNTY, KANSAS, TO BE UNSAFE AND
DANGEROUS, DIRECTING
THAT SAID STRUCTURE BE
REPAIRED OR RAZED AND
REMOVED, AND ESTABLISHING A REASONABLE
TIME WITHIN WHICH SUCH
ACTION SHALL COMMENCE, ALL IN ACCORDANCE WITH K.S.A. 12-1750,
ET SEQ., AND CHAPTER V,
ARTICLE 11 OF THE CODE
OF THE CITY OF LAWRENCE, KANSAS, 2013 EDITION, AND AMENDMENTS
THERETO.

WHEREAS, at its February
18, 2014, regular meeting,
the Governing Body
passed Resolution No.
7058, wherein it recited
that, in accordance with
the Unsafe and Dangerous
Structures and Abandoned
Property Act of 1961 ("the
Act"), codified as
amended at K.S.A. 12-1750
et seq., and Chapter V, Article 11 of the Code of the
City of Lawrence, Kansas,
2013 Edition, and amendments thereto, the Enforcing Officer for the City of
Lawrence, Kansas, had
filed with the Governing
Body a written statement
averring that the structure
located on that real property commonly known as
1321 Tennessee Street,
Lawrence, Douglas County,
Kansas, the legal description of which is set forth at
Section 2, infra, is unsafe
and dangerous; WHEREAS,
in Resolution No. 7058, in
accordance with the Act,
the Governing Body directed the owner, the
owner's agent, any
lienholder of record, and
any occupant of said
structure to appear before
it in the City Commission
Room, First Floor, 6 East
6th Street, Lawrence, Kansas, on April 8, 2014, at 6:35
p.m., to show cause why
said structure should not
be condemned and
ordered repaired or demolished as an unsafe and
dangerous structure;
WHEREAS, in accordance
with the Act, Resolution
No. 7058 was published in

second publication date of

to repair, alter, extend, reconstruct, enlarge or improve the Water and
Sewer System (the
"System") owned and operated by the Issuer, as
follows:

(the "Project") at an estimated cost of $26,500,000.

In order to finance the
Project including related
bond reserves and financing costs, the governing
body of the Issuer further
intends to issue Water and
Sewer System Revenue
Bonds, in an amount not to
exceed $32,000,000 (the
"Bonds") in one or more
series under the authority
of K.S.A. 10 1201 et seq.
The Bonds will not be general obligations of the Issuer payable from taxation, but shall be payable
only from net revenues of
the System. The proceeds
of the Bonds will be used
to pay the costs of the
Project and related bond
reserves and financing
costs.

This Notice shall be published one time in the official newspaper of the Issuer, and if within fifteen
(15) days after the date of
said publication there
shall be filed with the
Clerk, a written protest
against the Project or the
issuance of the Bonds,
signed by not less than
twenty per cent (20%) of
the qualified electors of
the City, then the governing body shall submit such
proposed Project and the
proposed Bonds to the
electors of the Issuer at a
special election to be
called for that purpose as
provided by the Act. If no
sufficient protest is filed
within said period of time,
the governing body shall
proceed with the Project
and the issuance of the
Bonds.

NOTICE TO THE PUBLIC

The Lawrence Board of
Zoning Appeals will hold a
public hearing on Thursday, May 1, 2014, at 6:30
p.m., in the Commission
Meeting Room, first floor
of City Hall at Sixth and
Massachusetts Street,
Lawrence. The following
item will be considered at
that time:

B-14-00138 : A request for
variances as provided in
Section 20-1309 of the Land
Development Code of the
City of Lawrence, Kansas,
2013 edition. The first request is for a variance
from the 75 percent maximum impervious site cover
standard found in Section
20-601(a) of the City Code
for property located in a
RSO (Single-Dwelling Residential Office) District.
The applicant is seeking
approval for a 77 percent
maximum impervious site
cover at 346 Maine Street;
and, an 84 percent maximum impervious site cover
at 302 Maine Street. The
second request is a variance from the 25 feet
off-street parking area
setback from a street
right-of-way in any residential district required in
Section 20-908(b) of the
City Code. The applicant is
requesting a 0 feet parking
area setback from the
north property line adjacent to W. 3rd Street for
the property at 346 Maine
Street as well as the property at 302 Maine Street;
and, a 7 feet parking area
setback from the west
property line adjacent to
Maine Street for the property at 302 Maine Street.
The final request is a variance from the interior
parking lot landscape
standard in Section
20-1003(c)(1) of the City
Code which requires a
minimum 40 square feet of
landscape area per parking stall. Based upon this
code standard, the applicant is required to provide
5,920 square feet of interior parking lot landscaping at 346 Maine Street;
they are asking for a variance to provide 4,268
square feet of interior
parking lot landscaping.
On the adjacent property
at 302 Maine Street, the
applicant is requesting an
interior landscape area reduction from the code required 960 square feet, to a
minimum of 637 square
feet. All of the variances
are requested for a project
designed to provide additional parking stalls at the
northern end of 346 Maine
Street and for development of a new parking
area on the corner property at 302 Maine Street.
