By agreeing to the conditions in this article you agree to allow lawrence.com and its parent company, The World Company, to:
- Electronically provide to the public music file(s) [mp3, m4a, etc.] from your band's album(s).
This includes, but is not limited to, posting music file(s) for download, hosting music file(s) on our servers, and streaming music file(s). You understand that lawrence.com will select up to three tracks from each album, or when possible will use the same tracks your band has already made available for download on another site (e.g. your band's Web site, etc.).
- Broadcast your band's music file(s) on lawrence.com's local music channel on the Sunflower Broadband cable system.
Where available, the posting and broadcast of these music file(s) will be accompanied by the corresponding album art, band Web site URL, or other information on how to learn more about your band or purchase your band's music.
Submitting materials does not guarantee that we will use them in any of our services or products.
We also reserve the right to restrict, suspend or remove your submitted materials at any time for any reason without prior notice or liability to us. In the event that your band's "music" totally blows ass, keep practicing and get back to us in a year or so.
lawrence.com agrees not to sell or otherwise profit directly from the use of these music file(s).
Advertising on lawrence.com or on Sunflower Broadband shall not be considered profiting directly from these music file(s). You understand you will receive no compensation or financial remuneration for this free service provided by lawrence.com, including, but not limited to, payments to you or any third parties.
All submitted content and materials copyrights, public performance rights and other rights are retained by the artist(s).
By submitting content and works, you maintain that:
- You have full right and power to enter into and maintain these Terms, and have secured any and all third-party consents, licenses and permissions necessary to enter into and maintain these Terms.
- The material that you submit to our sites does not contain illegal samples of any third party's copyrighted work and will not infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights, rights of publicity or privacy.
- The material that you submit is not and will not violate any law, statute, ordinance or regulation.
- The material that you submit is not and will not be defamatory, trade libelous, pornographic or obscene.
- You are at least eighteen years of age.
As the creator and/or authorized representative of the band's music file(s), you assume all liability for copyright infringement (for example, excessive sampling), defamation or other laws broken by the music file. PLEASE DO NOT SUBMIT SUCH FILE(S)!
Here's the extended, legalese version of the above idea: You hereby agree to indemnify, defend and otherwise hold lawrence.com and The World Company, and all of our staff, information providers, affiliates and licensors harmless from and against any and all liability, losses, costs and expenses (including attorneys' fees) incurred by lawrence.com in connection with any claim arising out of the material that you submit, including, but not limited to, claims for defamation, violation of rights of publicity and/or privacy, copyright infringement, trademark infringement and any claim or liability relating to the content, quality, or performance of materials that you submit.
